U.S. Court of Appeals Case No: 07-3874
District of North Dakota - Fargo
[PUBLISHED] [Wollman, Author, with Beam and Benton, Circuit Judges]
Criminal Case - conviction. Warrantless entry and search of hotel room
following complaints of loud noise and hotel's decision to evict occupants
did not violate defendant's Fourth Amendment rights, as he no longer had
a reasonable expectation of privacy. District court did not err in denying
motion to suppress evidence found incident to defendant's arrest. A
reasonable jury could have found defendant guilty based on evidence
presented.
