Civil case. In action by former employer against three employees who
set up a competing business, the district court did not err in finding that
the employer had failed to prove that the men took trade-secret
information or that it had taken reasonable steps to protect its trade
secrets; as a result, the district court did not err in refusing to issue
injunctive relief to the employer on its trade-secret claim; with respect to
the employer's claim for statutory breach-of-loyalty under North Dakota
Century Code Sec. 34-02-14, the court did not err in concluding that
while the employer had a likelihood of success on its claims, injunctive
relief was not warranted based on factors which favored defendants, such
as irreparable harm, balance of harms, and the public interest.
