U.S. Court of Appeals Case No: 08-1039
U.S. District Court for the District of South Dakota
[PUBLISHED] [Gruender, Author, with Smith, Circuit Judge, and
Rosenbaum, District Judge]
Criminal case - criminal law. Evidence, including evidence regarding
defendant's identity, was sufficient to support the district court's
finding that defendant had violated his supervised release; while the
district court erred in admitting hearsay evidence at the revocation
hearing, the error was harmless in light of the other admissible
evidence establishing the violations.
