U.S. Court of Appeals Case No: 08-1043
and No: 08-1209
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Wollman, Author, with Beam and Benton, Circuit
Judges]
Criminal case - criminal law. In prosecution for bankruptcy fraud, no
error in admitting defendants' statements in bankruptcy court proceedings
as the statements were clearly relevant to the issue of defendants' intent
and the court gave a proper limiting instruction; court did not abuse its
discretion in refusing to sever the defendants' cases, as defendant Cyril
was not prejudiced or incriminated by defendant Rae's bankruptcy court
filings; admission of the couple's bankruptcy attorney's testimony did not
violate Rae's privilege against self-incrimination; evidence was sufficient
to establish that defendants committed bankruptcy fraud by concealing
assets and misrepresenting the value of their home.
