U.S. Court of Appeals Case No: 08-1082
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Bye, Author, with Beam and Colloton, Circuit Judges]
Civil case - Employment law. While the district court erred in concluding as a matter of law that plaintiff failed to provide her employer with enough information to put it on notice that she may be in need of Family Medical Leave Act leave, plaintiff was not entitled to prevail on her claim that the employer interfered with her exercise of her rights under the Act as she failed to show that she was terminated for a reason connected to her FMLA; similarly, the district court did not err in determining plaintiff was not terminated in retaliation for exercising her rights under the Act; even if plaintiff showed a prima facie case of retaliation, she failed to show that the employer's stated legitimate grounds for discharge were a pretext for discrimination and retaliation. Judge Colloton, concurring.
