U.S. Court of Appeals Case No: 08-1148
U.S. District Court for the Western District of Missouri - Jefferson City
[PUBLISHED] [Gruender, Author, with Melloy and Beam, Circuit Judges]
Civil case - Insurance. District court did not err in determining the
proper of measure of damages for Bluewood's flood losses; the court
concludes that it is likely that the Missouri Supreme Court would find
that MO. Rev. Stat. Sec. 379.150 applies only to cases involving loss by
fire, and that its measure of damages provisions would not apply to this
case; other challenges to jury instructions rejected; no error in admitting
Cincinnati's expert's testimony concerning growth and remediation of
mold.
