Criminal case - Sentencing. Case remanded for resentencing in light of
this court's decision in U.S. v. Williams, 527 F.3d 969 (8th Cir. 2008) as
defendant's conviction for motor vehicle theft is not a violent felony;
however, on remand, the district court may consider a prior conviction for
making a terroristic threat under Minn. Stat. Sec. 609.713, subd. 1, as it is
a violent felony within the meaning of 18 U.S.C. Sec. 924(e)(2)(B)(I) and
Guidelines Sec. 4B1.2(a)(1).
