U.S. Court of Appeals Case No: 08-1172
U.S. District Court for the Southern District of Iowa - Davenport
[PUBLISHED] [Smith, Author, with Wollman and Gruender, Circuit
Judges]
Civil case - Social Security. ALJ did not err in balancing the medical
evidence in the record or in finding that the treating physician's RFC
assessment was not entitled to controlling weight because it was
contradicted by the medical record and internally inconsistent; ALJ did
not err in omitting drowsiness from the question posed to the vocational
expert as there was no evidence that the drowsiness claimant experience
was uncontrollable or restricted his ability to work.
