   not err in dismissing plaintiff's action for retaliatory discharge, as 
   the Surface Transportation Assistance Act's jurisdiction conferring
   amendment increased the universe of employees who could pursue their
   claims in federal court, and applying the Act retroactively would impose
   new obligations affecting defendant's substantive rights.
