U.S. Court of Appeals Case No: 08-1276
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Loken, Author, with Wollman and Smith, Circuit Judges]
Civil case - torts. District court did not err in granting Regions
summary judgment on plaintiff's abuse of process claim as there was no
evidence Regions took any action after the issuance of a search warrant
that could reasonably be found to constitute an abuse or perverted misuse
of that process; no error in dismissing plaintiff's Section 1983 claim as
there was no evidence that any employee of Regions was involved in the
state police's decision to seek a warrant.
