U.S. Court of Appeals Case No: 08-1343
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Shepherd, Author, with Bye and Beam, Circuit Judges]
Civil case - employment discrimination. Under the facts of the case,
where the employer rescinded an initial employment action and reinstated
plaintiff with full back pay and seniority, the district court did not err
in finding the employer's initial action against plaintiff did not
constitute an adverse employment action for purposes of her race and
gender discrimination claims and did not err in granting the employer's
motion for summary judgment; plaintiff's retaliation claim failed as she
failed to establish a causal connection between her EEOC charge and the
employer's action.
