U.S. Court of Appeals Case No: 08-1364
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Riley, Author, with Bright and Melloy, Circuit Judges]
Criminal Case - sentence. District court did not err in granting an
upward variance from 15-21 month sentencing range to 51 months
imprisonment for enticing an adult female to travel in interstate
commerce for purposes of prostitution. Court did not commit significant
procedural error, or plain error in explaining the reason for the variance
or in comparing offense to other crimes or in concluding Guidelines
range was insufficient to accomplish purposes of sentencing. Sentence
was not unreasonable. Judge Bright dissents on basis for upward
variance.
