U.S. Court of Appeals Case No: 08-1449
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Colloton, Author, with Riley and Bowman, Circuit Judges]
Criminal case - criminal law. In a prosecution for felon in possession of
a firearm, the district court did not err in allowing police officer to
testify that he was responding to a report of "shots fired," as the
testimony was admissible under Rules 403 and 404(b); even if admission
of testimony about defendant's aggressive behavior was error under Rule
403, the error was harmless; evidence was sufficient to support
conviction for being a felon in possession of a firearm.
