U.S. Court of Appeals Case No: 08-1474
U.S. District Court for the Western District of Missouri - St. Joseph
[PUBLISHED] [Melloy, Author, with Beam and Gruender, Circuit Judges]
Civil Case - Employment discrimination. Und er Missouri law, contributing factor is the standard governing a Missouri Human Rights Act retaliation claim, and district court applied the correct standard to plaintiff's claim; jury verdict for plaintiff was supported by sufficient evidence; jury's finding with respect to lost wages and benefits was supported by the evidence, as were its findings regarding plaintiff's future pecuniary losses and her nonpecuniary losses; evidence was sufficient under Missouri law to submit the issue of punitive damages to the jury; however, the award was excessive when viewed in the light of prevailing due process limitations, as they were 50 greater than her lost wages and benefits, 25 times greater than her other compensatory damages and approximately 16 times greater than her total damage award; as a result, the court reduces the punitive damage award from $500,000 to $120,000; award of $220,000 in attorneys's fees and costs is affirmed.
