U.S. Court of Appeals Case No: 08-1498
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Shepherd, Author, with Bye and Beam, Circuit Judges]
Civil case - Family and Medical Leave Act. Plaintiff failed to show he
reasonably relied on employer's statements concerning his request for
FMLA leave, and the employer was not estopped from contesting his
right to assert an FMLA claim or from terminating him for excessive
absences; district court did not err in finding the claim was time-barred by
FMLA's two-year statute of limitations; plaintiff was not eligible for
relief under Department of Labor regulations implementing FMLA
because he never completed the necessary form stating he was unable to
work because of a qualifying health condition.
