Criminal Case - conviction and sentence. District court did not err in
denying motion to suppress confession given during interrogation and
after Miranda warnings issued, as findings that detectives did not
overcome defendant's will and statements were made voluntarily were not
clearly erroneous. District court did not abuse its discretion in denying
motion to recuse, as district court concluded defendant's threat against
him was an effort to manipulate the criminal justice system, defendant
lacked capacity to carry out threat against him, and the average observer
would not reasonably question the court's impartiality. Although
sentence was above the guidelines range, the record shows district court
considered the section 3553(a) factors, adequately explained the sentence,
and properly considered the attempts to obstruct justice. Thus, no
procedural error existed. District court did not abuse its discretion in
imposing sentence, as sentence was substantively reasonable.
