U.S. Court of Appeals Case No: 08-1589
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Melloy, Author, with Benton, Circuit Judge, and Doty,
District Judge]
Criminal Case - sentence. District court did not err in applying section
2C1.2 enhancement based on Bates's flight from and struggle with
officers, while armed with a loaded weapon. Application of four-point
enhancement under section 2K2.1(b)(6), for possessing a firearm in
connection with another felony was error because district court did not
find affirmatively that the firearm and drug felonies were adequately
connected.
