U.S. Court of Appeals Case No: 08-1756
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Shepherd, Author, with Beam and Gruender, Circuit Judges]
Civil case - Social Security. While the ALJ erred in failing to confine
his step-one analysis to the time period when claimant was last insured
for purposes of disabled widow's benefits, his ultimate conclusion that
claimant was not engaged in substantial gainful activity was correct, and
his step-one determination was supported by substantial evidence;
however, the ALJ's step-four analysis as to whether the claimant retained
the residual functional capacity to perform her past relevant work was
also erroneous as the ALJ's finding that clamant had past relevant work
as a substitute teacher was not supported by substantial evidence; case
remanded for further proceedings consistent with the opinion.
