U.S. Court of Appeals Case No: 08-1972
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Bowman, Author, with Melloy and Smith, Circuit Judges]
Criminal case - criminal law. After a lawful traffic stop, the officer
engaged defendant in lawful questioning about his identity which was
reasonably prolonged when the false name defendant gave came back as
not on file; defendant did not make an unequivocal and clear request for
an attorney, and the officer did not violate his rights by continuing to
speak with him; assuming the line of questioning concerning a firearm
was hearsay and any objection was not waived by defendant's pursuit of
the same line of questioning, any prejudice was minimal, given the nature
of the testimony and the court's giving of a limiting instruction.
