Union's decision to pursue advisory Alternative Dispute Resolution rather than full arbitration was not arbitrary, discriminatory or made in bad faith; union agreement to limit back pay damages as part of the advisory ADR process did not breach union's duty of fair representation; union's failure to inform plaintiff of the cap on back pay did not rise to level of arbitrary, discriminatory or bad faith conduct and did not establish a breach of its duty of fair representation.
