Prisoner case - habeas. Noe's trial attorney did not have a conflict of
interest and was not engaged in joint representation, and the district court
did not err in denying Noe's claims of ineffective assistance of counsel;
Noe also failed to show that counsel's trial strategy and decisions
constituted ineffective assistance; even if there was a conflict, Noe make
a knowing, voluntary and intelligent waiver of his right to conflict-free
assistance of counsel; no error in denying motion for an evidentiary
hearing; certificate of appealability would not be expanded to other
issues.
