U.S. Court of Appeals Case No: 08-2086
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Smith, Author, with Murphy, Circuit Judge, and
Limbaugh, District Judge]
Criminal case - Sentencing Guidelines. Government did not breach
plea agreement by asking for a sentence greater than the low end of the
guidelines range as the government did not make a definite oral promise
to ask for a low-end sentence; as a result, defendant was not released of
his obligation not to advocate a sentence below the guidelines range, and
the case would not be remanded for the purpose of allowing him to seek
such a sentence.
