U.S. Court of Appeals Case No: 08-2203
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Arnold, Author, with Loken, Chief Judge, and Beam,
Circuit Judge]
Criminal case - criminal law. District court did not err in finding
warrant application was supported by probable cause as the facts recited
in the application, taken together, made it fairly probable that drugs
would be found in the apartment; district court did not err in allowing the
government to introduce defendant's probation file in to prove that he had
not told his probation officer that he was being harassed by the police
prior to his arrest; no error in admitting utility records to rebut testimony
of a witness who testified she had stayed at defendant's apartment when
she lost her power.
