Civil case - ERISA. In an action to recover unpaid contributions, the
court erred in piercing the corporate veil because the pension funds did
not produce sufficient evidence to establish that the corporation was used
as a subterfuge to defeat public convenience, justify wrong, promote
injustice or perpetrate a fraud; as a result, the court erred in granting
summary judgment for the funds, and the matter is remanded for further
proceedings.
