U.S. Court of Appeals Case No: 08-2283
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Bye, Author, with Murphy, Circuit Judge, and Strom,
   District Judge]
Civil case - ERISA. In an action to recover unpaid contributions, the court erred in piercing the corporate veil because the pension funds did not produce sufficient evidence to establish that the corporation was used as a subterfuge to defeat public convenience, justify wrong, promote injustice or perpetrate a fraud; as a result, the court erred in granting summary judgment for the funds, and the matter is remanded for further proceedings.
