U.S. Court of Appeals Case No: 08-2377
District of Nebraska - Omaha
[PUBLISHED] [Colloton, Author, with Shepherd, Circuit Judge, and
Goldberg, Court of International Trade]
Criminal Case - suppression. District court's erred in granting motion to
suppress statement and crack cocaine found in defendant's pocket when
he was questioned in connection with a routine traffic stop; Miranda
warnings were not required because defendant was not subjected to the
functional equivalent of a formal arrest before the office asked him
questions. Fifth Amendment challenge can be raised on remand.
