Criminal case - criminal law. For the court's opinion on defendant's direct criminal appeal, see United States v. Coplen, 533 F.3d 929 (8th Cir. 2008). District court did not abuse its discretion in denying defendant's motion for new trial based on newly discovered evidence because, as a whole, the evidence would not likely result in an acquittal; defendant failed to establish a Brady violation.
