analysis and kept the ultimate burden of proof on the government in
ruling on the government's objection that three of defendant's
peremptory strikes were improperly based on the jurors' gender; district
court did not abuse its discretion in ruling that defense witness's
proposed testimony concerning an altercation between defendant and the
victim was cumulative. Judge Bye, concurring in part and dissenting in
