U.S. Court of Appeals Case No: 08-2423
and No: 08-2465
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Murphy, Author, with Melloy and Shepherd, Circuit Judges]
Civil case - Contracts. District court did not err in excluding certain lay
opinion testimony from plaintiff's president concerning lost profits as his
testimony amounted to speculation and conjecture and he lacked relevant
and recent activity in the market in question; nor did the court err in
excluding plaintiff's expert's proposed testimony as the testimony would
have relied almost exclusively on the excluded lay testimony without any
independent investigation or analysis.
