U.S. Court of Appeals Case No: 08-2684
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Shepherd, Author, with Murphy and Melloy, Circuit Judges]
Criminal case - Sentencing. Even if the district court abused its
discretion in imposing a two-level enhancement under Guidelines Sec.
3B1.1(c) for a management role in the offense, the error has no effect on
defendant's sentence, and the court would not review the issue; district
court adequately reviewed the Section 3553(a) factors in setting sentence
and specifically addressed the factors raised in defendant's appeal;
sentence was not unreasonable.
