U.S. Court of Appeals Case No: 08-2818
U.S. District Court for the Western District of Arkansas - El Dorado
[PUBLISHED] [Smith, Author, with Bye and Colloton, Circuit Judges]
Civil case - Torts. District court did not err in declining to allow the
jury to apportion a percentage of fault to a company not a party to the
suit; jury instructions concerning intervening events were not erroneous;
even if the district court erred in excluding an occupational therapist's
report, defendant Augusta has failed to show how it was prejudiced by
the error and there was no reversible error; report was not admissible
under Federal Rule of Evidence 106.
