U.S. Court of Appeals Case No: 08-2835
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Shepherd, Author, with Murphy and Melloy, Circuit Judges]
Civil case - insurance. The district court erred in finding Weitz had
not complied with the insurance policy's notice-of-loss provision, and
the district court erred in granting the insurers' motion for summary
judgment on Weitz's breach-of-contract claim; on remand the district
court should determine whether Illinois or Iowa law governs Weitz's
claim for bad-faith denial of coverage claim; while it did not reach the
issue of whether Illinois or Iowa law applied, the district court erred
in granting the insurers summary judgment on the claim based on its
analysis of the claim under Iowa law.
