U.S. Court of Appeals Case No: 08-2858
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Colloton, Author, with Wollman and Riley, Circuit
Judges]
Criminal case - criminal law. District court did not commit plain error
by admitting tape recordings into evidence as the recordings, while of
poor quality, were audible enough to provide the jury with the gist of the
conversations, and the inaudible portions were not so pervasive as to
render the recordings untrustworthy as a whole; district court did not
abuse its discretion in admitting evidence of defendant's 1996 drug
conviction, as the convictions were admissible under Rule 404(b) because
they were relevant to defendant's intent and knowledge and involved an
offense similar in kind to the charges here; evidence was sufficient to
show defendant conspired to distribute 1000 kilos or more of marijuana.
