U.S. Court of Appeals Case No: 08-3000
U.S. District Court for the Western District of Missouri - Springfield
[PUBLISHED] [Benton, Author, with Arnold and Gruender, Circuit Judges]
Civil case - employment discrimination. Plaintiff failed to establish
actionable harm, and the district court did not err in granting defendants'
motion for summary judgment on her hostile work environment claim;
with respect to her retaliation claim, plaintiff failed to show that a
reasonable person would have perceived the retaliatory action as
materially adverse; petty slights and minor annoyances by non-
supervisory co-workers are not sufficient to support a conclusion that
they were materially adverse retaliatory actions.
