U.S. Court of Appeals Case No: 08-3010
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Bye, Author, with Loken, Chief Judge, and Miller,
District Judge]
Prisoner case - habeas. District court did not err in determining that the
Minnesota Supreme Court had made an unreasonable application of
Crawford v. Washington, 541 U.S. 36 (2004), when it found admission
of statements the victim made to a social worker in the presence of a
detective did not violate Bobadilla's Sixth Amendment Confrontation
Clause rights, as the statements were testimonial in nature; while there
was other evidence of Bobadilla's guilt, admission of the statements was
not harmless error as the prosecution's case rested heavily on the social
worker's testimony and her videotape of the interview with the victim.
