U.S. Court of Appeals Case No: 08-3022
U.S. District Court for the Northern District of Iowa - Cedar Rapids
[PUBLISHED] [Riley, Author, with Smith and Colloton, Circuit Judges]
Criminal Case - criminal law. The Fourth Amendment does not require
the judge issuing a search warrant to record sworn supplementary oral
testimony, and the judge's failure to do so does not violate the Fourth
Amendment or prevent meaningful review of the probable cause finding;
since this was a state court warrant, sought and executed by state
officers, Fed. R. Crim.P. 41(d)(2)(c) does not apply to the analysis.
