Civil case - Equal Educational Opportunities Act. In suit alleging
district discriminated against students who had recently immigrated to the
U.S., plaintiffs failed to state a Title VII claim because they failed to
show that the district's policy of delayed learning disability testing for
non-English language students was discrimination on the basis of
national origin; deficient programming in and of itself is not evidence of
intentional discrimination on the basis of national origin, and plaintiffs
failed to show a similarly situated comparison group the school treated
more favorably; assuming the district's failure to take appropriate action
to overcome language barriers that impeded equal participation in
learning was on account of national origin, the district court did not err in
dismissing plaintiffs' Equal Education Opportunities Act claim because
injunctive relief would not be available to these plaintiffs because none of
them attend the school or will ever return and because money damages
are not provided for in the Act.
