U.S. Court of Appeals Case No: 08-3077
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Riley, Author, with Benton and Shepherd, Circuit Judges]
Civil case - Order of the Federal Trade Commission. Defendant was
afforded due process of law during the district court's hearing on the
FTC's complaint that defendant was in contempt of a 1997 order
enjoining him from certain activities, as defendant had adequate notice of
the FTC's intent to seek sanctions and disgorgement of profits, as well as
an opportunity to contest the FTC's calculation of his profits from the
scheme; the district court did not err or abuse its discretion in adopting
the receiver's calculation of defendant's proceeds; challenges to district
court's order compelling defendant to turn over property he held in
Nevada rejected; no error in ordering defendant to turn over assets in his
IRA.
