District court did not err in finding defendant waived its right to invoke the arbitration clause in its payday loan agreements with the plaintiffs when it filed an extensive motion to dismiss the action before seeking to invoke the clause; defendant knew it had a right to arbitration, acted inconsistently with the right and its actions prejudiced plaintiffs.
