U.S. Court of Appeals Case No: 08-3326
U.S. District Court for the District of South Dakota
[PUBLISHED] [Smith, Author, with Shepherd, Circuit Judge, and
Stephen N. Limbaugh, Jr., District Judge]
Civil case - torts. In a suit for alienation of affection, the district court did not abuse its discretion in excluding evidence that the defendant had affairs with men other than plaintiff's former husband, as there was no evidence she had alienated the other men's affections or was aware that their affections had been alienated; in the absence of such evidence, the evidence of the affairs would only have been relevant to show she had a propensity for affairs, a prohibited purpose under Rule 404(a).
