U.S. Court of Appeals Case No: 08-3331
U.S. District Court for the Northern District of Iowa - Cedar Rapids
[PUBLISHED] [Colloton, Author, with Riley and Smith, Circuit Judges]
Criminal case - Sentencing. The word "stolen" as used in Guidelines
Sec. 2K2.1(b)(4) includes all felonious or wrongful takings with an intent
to deprive the owner of the rights and benefits of ownership regardless of
whether or not the theft constitutes common-law larceny; applying this
definition, the firearm in question was stolen and the district court did not
err in imposing a two-level increase; sentence was not unreasonable.
