District court did not err in denying motion for judgment of acquittal, as there was sufficient evidence to support conviction for conspiracy to manufacture and distribute crack cocaine and to distribute powder cocaine. District court did not abuse its discretion in denying motion for new trial, as El Herman declined to seek a mistrial after prejudicial statement was made and could not expect a new trial after jury returned guilty verdict.
