U.S. Court of Appeals Case No: 08-3537
U.S. District Court for the Eastern District of Arkansas - Jonesboro
[PUBLISHED] [Wollman, Author, with Melloy and Gruender, Circuit Judges]
Civil case - Social Security. ALJ erred in discrediting the opinion of
claimant's treating physician that claimant could not perform light work, as
that opinion was consistent with the other evidence in the record and was
not contradicted by any other medical evidence; as a result, the ALJ's
finding that claimant can perform her past work as a food service worker
is not supported by substantial evidence, and the matter is remanded to
the district court with instructions to remand the case to the Social
Security Administration for further consideration.
