Criminal case - Sentencing. Claim that sentence reduction was
imposed in violation of law because the district court did not give
defendant an opportunity to be heard was without merit as this court has
never held that a Rule 35(b) defendant has the right to an opportunity to
be heard; because defendant's claims do not satisfy any of the criteria
listed in 18 U.S.C. Sec. 3742(a), the court was without jurisdiction to
hear the appeal.
