U.S. Court of Appeals Case No: 08-3661
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Gruender, Author, with Arnold and Murphy, Circuit Judges]
Civil case - contracts. Petroleum restriction was part of the parties' real estate contract and the provisions of the contract and restriction had to be considered together; district court did not err in enforcing the petroleum restriction as it continued to benefit BP and the changes in BP's circumstances and business plans were not such as they defeated the purpose of the restriction, which required plaintiff to buy his petroleum products from BP for a period of at least 10 years.
