U.S. Court of Appeals Case No: 08-3663
U.S. District Court for the District of South Dakota
[PUBLISHED] [Melloy, Author, with Smith and Shepherd, Circuit Judges]
Criminal case - Sentencing. For the court's prior opinion in the case
see United States v. Azure, 536 F.3d 922 (8th Cir. 2008); on remand, the
district court did not err in rejecting defendant' argument that she killed
the victim in self-defense; district court did not err in assigning
hypothetical criminal-history points based on defendant's prior conduct;
sentence was not unreasonable, and the district court did not abuse its
discretion in making defendant's sentences consecutive.
