U.S. Court of Appeals Case No: 08-3816
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Loken, Author, with John R. Gibson and Gruender,
Circuit Judges]
Criminal case - criminal law and sentencing. Application for search
warrant established probable cause to search defendant's residence for
evidence of drug trafficking; 21 U.S.C. Sec. 841(b)(1)(B) does not violate
the double jeopardy clause since the increased punishment set out in the
statute is a stiffened penalty for the current crime and not an increases
penalty for the earlier crime.
