U.S. Court of Appeals Case No: 08-3821
U.S. District Court for the Northern District of Iowa - Cedar Rapids
[PUBLISHED] [Shepherd, Author, with Murphy and Smith, Circuit Judges]
Criminal case - Sentencing. District court did not clearly err in denying
defendant's request for an acceptance-of-responsibility reduction when
his comments showed he did not take responsibility for the fraud and
attempted to portray himself as the victim; court followed the proper
procedure and applied the relevant factors in determining whether the
sentence in this case should be consecutive to two other sentences, and
its decision to impose a consecutive sentence was reasonable.
