U.S. Court of Appeals Case No: 08-3829
Board of Immigration Appeals
[PUBLISHED] [Benton, Author, with Loken, Chief Judge, and Viken,
District Judge]
Petition for Review - Immigration. Court lacked jurisdiction to review
denial of petitioner's asylum claim; with respect to his claims for
withholding of removal and relief under the Convention Against Torture,
the Immigration Judge provided specific, cogent reasons for disbelieving
petitioner's evidence, and the court would defer to the findings; the
adverse credibility findings are fatal to petitioner's claim for withholding
of removal; petitioner failed to show that he would be subjected to torture
if he returned to Pakistan, and his claim for relief under the Convention
Against Torture was properly denied.
