U.S. Court of Appeals Case No: 08-3860
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Murphy, Author, with Loken, Chief Judge, and Bye,
Circuit Judge]
Civil case - employment discrimination. District court erred in finding
plaintiff had not made out a prima facie case of sex discrimination as her
evidence of sex stereotyping was sufficient to satisfy the fourth prong of
the McDonnell Douglas analysis; plaintiff's evidence was also sufficient
to create a genuine factual dispute as to whether the employer's stated
grounds for her discharge were pretextual; the order granting defendant
summary judgment is reversed, and the matter is remanded for further
proceedings. Chief Judge Loken, dissenting.
