U.S. Court of Appeals Case No: 08-3883
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Smith, Author, with Bye and Arnold, Circuit Judges]
Criminal Case - suppression and peremptory challenges. Affidavit in
support of search warrant established probable cause, information
obtained three to four days before execution of warrant did render
information stale, informant's information was sufficiently corroborated,
effort to pinpoint source of odor was unnecessary. District court did not
clearly err in denying Batson challenge, as distinctions, although fine,
were not meaningless, irrelevant or unconnected to legitimate trial
strategy.
